The offers and services we provide create opportunities for people to develop their artistic skills & exercise their creative potential in order to achieve positive change for people & communities.
Types of offers and services include:
Courses and workshops
Training and mentoring
Events
Exhibitions including the sale of artwork
Published, self published and commissioned materials such as activity books or loan boxes
Space and equipment hire
Consultancy
Project delivery
Changes to this agreement
We may change our Terms and Conditions from time to time. In that case, the ‘last updated’ date at the top of this page will also change. Any changes will apply immediately.
If these changes affect your engagement with us we will take reasonable steps to let you know.

Our website contains the most up-to-date information regarding dates, information and offer and service content.
Prices and payments
Where to find our prices
Where possible prices for our offers and services are made available on our website. For some bespoke offers and services an enquiry to our offices may be required.
Price adjustments
We reserve the right to adjust our prices at any time. Where possible we will provide 14 days notice of price changes.
VAT
The majority of our offers and services are not VAT applicable.
A limited number of offers and services are subject to VAT and in this case VAT will be added and made clear to any stated fees.
Currency
Our prices are in GBP sterling.

Payment is due in advance for the following offers and services:

Bespoke payments terms may be applied to the following offers and services:

Bank Transfer including Direct Debit and Standing order
Online and in person Credit and Debit cards
Cash
Gift cards or vouchers issued by our organisation
Payment
Customers agree to pay for orders made in accordance with the pricing and billing terms in effect at the time of purchase. Customers must also agree to pay all applicable taxes. We share payment information and instructions required to complete the transaction between ourselves, payment processors and their third party payment service providers (e.g transaction processing, merchant settlement and related services) and no additional notice or consent is required for the foregoing authorisations.
What happens if a payment is not received
If a payment is not received we will notify the customer and withhold the supply of offer or service until received.
Limitation of liability
In purchasing and making use of our offers or services you agree that use is at your own risk and we will not be liable for any loss or damage which may arise.
Our company is not responsible for inaccurate information on our website, social media profiles or third party listing sites.
Our liability will never exceed the price paid by the customer for any part of our offer or services.
Governing law
These Terms and Conditions are governed by English law and any dispute will be subject to the jurisdiction of English Courts.
Acceptable use and code of conduct
We have a code of conduct which we expect people using our offers and services to abide by. This requires anyone using our offers and services to conduct themselves in a considerate and respectful manner that does not pose any risks to themselves or others.
Specific codes of conduct, ground rules or health and safety requirements may be shared on a per offer or service basis and should be followed at all times of engagement.
Unacceptable behaviours include but are not limited to:
Any breach of our policies, including Health and Safety, Safeguarding and Equality and Diversity
Behaving in an inappropriate, unsafe, disruptive or unsuitable manner
Making copies of content published on our website or shared with you at any point of your engagement with us and our offers and services
Demonstrate respect for others and help to create an environment where everyone is treated with dignity and respect, having regard to people’s different needs, attitudes and lifestyles. Discriminatory behaviour will not be tolerated and will be dealt with accordingly.
Violating the terms of this clause will result in a verbal or written warning or withdrawal from our offers or services.
Access to and use of our services
Your access to and use of our services and offers is subject to these terms and conditions and all applicable laws and regulations.
You may not:
Access or use the offers or services if you are not fully able and legally competent to agree to these terms and conditions or authorised to use our services or offers by a parent or legal guardian
Make unauthorised copies, modify, adapt, translate, disassemble or create any derivative works of our offers or services or any content therein
Distribute, licence, transfer or sell in whole or in part any of the services of offers or their derivatives
Market, rent or lease our offers or services for a fee or charge, or use our offers or services to advertise or perform any commercial activity
Use the offers of services without express written consent, for any commercial or unauthorised purpose including communicating, facilitating, advertising, soliciting or spamming
Intellectual property
Unless otherwise stated all materials on our website and in the communal spaces of our building belong to our organisation or artists that work with us or in our spaces. Viewing and accessing these materials is solely for personal non commercial use unless covered by prior written agreement.
Cancellation by us
If we find it necessary to cancel any of our offers or services such as a class, workshop or session, all customers will be notified immediately. If an activity must be cancelled completely, we will give customers the opportunity to transfer their payment to another offer or service of equal value subject to availability. In exceptional circumstances and subject to our discretion we will provide a full refund.
If unplanned or unforeseen circumstances prompt a singular session of a multi-week activity to be cancelled, we will contact all customers immediately, informing them of an alternative date to make up the total number of sessions. Alternatively, the offer of a refund for the singular session will be offered.
Any refunds will be made within four weeks of the cancellation date.
Cancellation by You
We provide customers the opportunity to transfer their payment to another offer or service of equal value, subject to availability. In exceptional circumstances and subject to our discretion, we will provide a 50% refund if advanced notice up to 14 working days prior to the offer or service start date is provided.
Please note there is an administration fee of £5 payable in respect of any refunds made to cover transaction and administration costs incurred.
You will need to speak to a member of office staff on 01422 346900 who will make a note of your cancellation and ask you to put your reason in writing to info@everybodyarts.org.uk before any credit notes or refunds can be issued.
Please note, if you withdraw within 14 working days prior to the offer or service start date, or after the offer or service has begun or supplied you will not be entitled to a refund.
We will consider the circumstances with fair and reasonable consideration.
Absences
If you or a student / participant you are responsible for is unable to attend for any reason then we must be informed immediately and will inform any stakeholders, in the case of a course or workshop the Artist delivering will be notified.
We request that you inform a member of the office staff at on 01422 346900 or info@everybodyarts.org.uk to record your absence.
Non attendance without notice
If participants enrolling onto any of our part or fully funded offers or services such as Access Funds or concessions do not give reasonable notice that they are unable to attend, we reserve the right to prevent enrolment onto future activities.
We will consider the circumstances with fair and reasonable consideration.
Changes and Cancellations
We aim to deliver all offers and services as advertised. However, offers or services may be cancelled, or changed, if minimum requirements such as enrolments are not met or in the event of unforeseen circumstances. Session dates and times may be provisional and subject to change.
Termination
We reserve the right to terminate customer accounts, access to offers of services, ban or place restrictions on use due to any breaches of these terms and conditions, where necessary without providing a reason or notice and will not be liable for any resulting loss.

We can accept no responsibility for errors or omissions. We reserve the right to introduce changes to the information given here, including the addition, withdrawal, relocation or restructuring of the offers or services.
